Thank you for choosing to use ExplainTXT - AI Reading Assistant. These terms of service ("Terms", "ToS") govern your use of the ExplainTXT Chrome extension (the "Service") operated by ExplainTXT ("us", "we", or "our").
Please read these Terms of Service carefully before using our Chrome extension. Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.
1. Access to the Service
Subject to these Terms, we grant you a non-transferable, non-exclusive, revocable, limited license to use and access the Service solely for your own personal, non-commercial use.
2. Accounts
When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.
3. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of ExplainTXT and its licensors.
4.Content
Our Service processes text selected by you in your browser for the purpose of providing AI-powered explanations. While we strive to accommodate a wide range of texts, there are circumstances under which we may be unable to process certain content. This may occur if the text is too complex, lacks sufficient context, or contains material that we determine, at our sole discretion, to be harmful, offensive, or otherwise inappropriate for processing. Inability to Process Text You acknowledge that not all text may be suitable or eligible for processing due to various reasons, including but not limited to: Complexity or Ambiguity: Texts that are overly complex or lack sufficient context may not be effectively processed by our AI algorithms. Inappropriate Content: Texts that contain harmful, offensive, illegal, or otherwise inappropriate content, as determined by our standards and policies, will not be processed. In such cases, we reserve the right to refuse processing of the text without providing a detailed explanation. Our decision to decline processing is final and not subject to appeal. User Responsibilities You are responsible for ensuring that the text you select and submit to our service complies with all applicable laws and does not infringe on any third party's rights. You agree not to submit text that: Is illegal, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive; Encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party; Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware. Liability for Content While you retain ownership of the text you provide to our service, you agree to assume all risks associated with its processing, including any reliance on its accuracy, completeness, or usefulness by others, or any disclosure of your text that makes you or any third party personally identifiable. We do not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any content processed by our service.
5. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with Terms. You agree not to use the Service:
- In any way that violates any applicable national or international law or regulation.
- For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
- To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
6. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
7. Indemnification
You agree to defend, indemnify, and hold harmless ExplainTXT and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
8. Limitation Of Liability
In no event shall ExplainTXT, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
9. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
